Minneapolis & St. Paul Ordinances

The cities of Minneapolis and Saint Paul have issued ordinances requiring employers to provide earned sick and safe time to employees, effective July 1. 2017.

A key announcement in the preliminary rules is that both the city of Minneapolis and the city of Saint Paul will not be enforcing their ordinances against employers that physically reside outside of their respective cities.

The ordinances state:

  1. For every thirty (30) hours worked, the employee shall accrue one (1) hour of earned sick and safe time. Earned sick and safe time will accrue only in hour-unit increments. The maximum number of earned sick and safe time hours an employee can earn in each calendar or fiscal year is forty-eight (48) hours.
  2. Employers must allow an employee to accrue up to eighty (80) hours of earned sick and safe time. Employers will allow an employee to carry over earned but unused sick and safe time into the following year (whether calendar or fiscal year), but time carried over is limited to the aforementioned caps. Employers may satisfy this requirement by providing at least forty-eight (48) hours of earned sick and safe time following the initial ninety (90) days of employment for use by the employee during the first year, and providing at least eighty (80) hours of earned sick and safe time beginning each subsequent year.
  3. If an employer has an existing paid-leave policy, such as PTO or vacation policy, they are not required to provide additional earned sick and safe time.
  4. An employer is not required to provide financial or other reimbursement to an employee for earned, but unused sick and safe time upon the employee's separation from employment.
