Beginning in 2023, employers sponsoring medical plans and insurers must attest to compliance with the prohibition on gag clauses rule by filing an electronic attestation with the Centers for Medicare and Medicaid Services no later than December 31 of each year.
The Consolidated Appropriations Act, 2021 contained several rules designed to increase and promote transparency in the health care and health insurance industries. This included the prohibition on gag clauses rule, which became effective on December 27, 2020. The rule prohibits major medical plans and insurance carriers from entering into contractual agreements with third parties that limit or restrict the plan and/or insurer from sharing or providing access to health care provider cost or quality information and claims data for certain purposes.
This webinar will cover the basics of the prohibition on gag clauses and employer obligations under the rule. We will also provide a detailed walkthrough on how to complete the attestation process if an insurance carrier and/or other third party is unable or unwilling to file the attestation on an employer’s behalf.
